By accessing or using Health264's healthcare technology platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Health264 (Pty) Ltd, a company incorporated under the laws of Namibia.

If you do not agree to these Terms, you may not access or use our Services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

Health264 provides a comprehensive healthcare technology platform designed to improve healthcare delivery in Namibia. Our Services include:

  • Healthcare provider directory and communication platform
  • Population health analytics and reporting

Service Availability

Our Services are primarily designed for use within Namibia and comply with Namibian healthcare regulations. Some features may not be available in all regions or to all user types.

Eligibility and Registration

User Categories

Our Services are available to the following categories of users:

  • Patients: Individuals seeking healthcare services in Namibia
  • Healthcare Providers: Licensed medical professionals, clinics, and hospitals
  • Insurance Companies: Authorized medical insurance providers
  • Government Agencies: Namibian health departments and regulatory bodies

Age Requirements

You must be at least 18 years old to create an account. Minors may use our Services only with parental or guardian consent and supervision.

Professional Requirements

Healthcare providers must maintain valid professional licenses and comply with all applicable medical practice regulations in Namibia.

User Accounts and Security

Account Creation

To access certain features, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.

Authentication

We use multi-factor authentication (MFA) and OTP-based verification to ensure account security. You agree to participate in these security measures.

Account Responsibility

You are solely responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

Acceptable Use Policy

Permitted Uses

You may use our Services only for legitimate healthcare purposes, including:

  • Facilitating healthcare delivery and communication
  • Processing insurance claims and payments
  • Conducting authorized healthcare research

Prohibited Activities

You agree not to:

  • Use the Services for any unlawful purpose or in violation of applicable laws

  • Interfere with or disrupt the Services or servers
  • Upload or transmit malicious code, viruses, or harmful content

Health Information and Privacy

Health Information Handling

We handle personal health information in accordance with applicable Namibian privacy laws and international healthcare data protection standards. All health data is pseudonymized using participant numbers to protect patient identity.

Consent for Data Processing

By using our Services, you consent to the collection, processing, and storage of your health information as described in our Privacy Policy. Healthcare providers must obtain appropriate patient consent before entering data into our system.

Data Accuracy

You are responsible for ensuring the accuracy of health information you provide. Healthcare providers must maintain professional standards when entering patient data.

Payment Terms and Billing

Service Fees

Certain Services may require payment of fees. All fees are quoted in Namibian Dollars (NAD) unless otherwise specified. We reserve the right to modify our pricing with 30 days' notice.

Payment Methods

We accept various payment methods including bank transfers, credit cards, and mobile money services available in Namibia. All payments must be made in advance unless otherwise agreed.

Refund Policy

Refunds are handled on a case-by-case basis. Service interruptions due to technical issues may qualify for service credits or refunds at our discretion.

Intellectual Property Rights

Our Intellectual Property

The Health264 platform, including all software, designs, text, graphics, and other content, is owned by Health264 and protected by intellectual property laws. You may not copy, modify, or distribute our intellectual property without written permission.

User Content

You retain ownership of health information and other content you provide. However, you grant us a limited license to use this content to provide our Services and improve healthcare outcomes.

Third-Party Content

Our Services may include content from third parties. We do not claim ownership of such content and respect the intellectual property rights of others.

Limitation of Liability

Service Availability

While we strive to provide reliable Services, we cannot guarantee uninterrupted access. We are not liable for service interruptions, data loss, or other technical issues beyond our reasonable control.

Medical Decisions

Our Services are tools to support healthcare delivery but do not replace professional medical judgment. Healthcare providers remain solely responsible for all medical decisions and patient care.

Limitation of Damages

To the maximum extent permitted by law, our liability for any damages arising from your use of the Services is limited to the amount you paid for the Services in the preceding 12 months.

Governing Law and Jurisdiction

Applicable Law

These Terms are governed by the laws of the Republic of Namibia. Any disputes arising from these Terms or your use of our Services will be resolved in accordance with Namibian law.

Jurisdiction

Any legal proceedings related to these Terms must be brought in the competent courts of Windhoek, Namibia. You consent to the exclusive jurisdiction of these courts.

Regulatory Compliance

Our Services comply with Namibian healthcare regulations, including those administered by the Ministry of Health and Social Services and other relevant regulatory bodies.

Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to users through our platform and via email. Continued use of our Services after changes constitutes acceptance of the modified Terms.

Effective Date

These Terms are effective as of December 2024 and supersede all previous versions.
